Terms & Conditions / End User License Agreement — Effective October 5, 2026

These Terms & Conditions ("Terms") govern your use of the DNGNZ CP mobile application (the "App"), developed and operated by Zoltan Rozsnyay (the "Developer"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Acknowledgement
These Terms are concluded between you and the Developer only — not with Apple Inc. ("Apple"). The Developer, not Apple, is solely responsible for the App and its content. These Terms do not provide usage rules for the App that conflict with the Apple Media Services Terms and Conditions, which you acknowledge you have had the opportunity to review.

2. Scope of License
The Developer grants you a non-transferable license to use the App on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing. You may not copy, modify, distribute, sell, lease, reverse-engineer, or create derivative works of the App except as permitted by applicable law.

3. The App and Its Limitations
The App uses your device's microphone to detect and count impulsive sounds (claps and slaps) in real time. Microphone access is used solely for this purpose and only while monitoring is active.
Sound levels displayed by the App are approximate, uncalibrated values derived from your device's microphone. The App is not a measuring instrument and must not be relied upon for health, safety, occupational, legal, or regulatory purposes.
Detection accuracy depends on your device, environment, and settings. The Developer does not guarantee that every intended sound is counted or that unintended sounds are never counted.
4. Privacy
The App processes audio entirely on your device, in real time. No audio is recorded, stored, or transmitted. The App collects no personal data, requires no account, and contains no advertising or analytics. Settings and the counter value are stored locally on your device only. 5. Maintenance and Support
The Developer is solely responsible for providing any maintenance and support services with respect to the App, as specified in these Terms or as required under applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App. Support inquiries: support@dngnz.com.

6. Warranty
The App is provided "as is" and "as available", without warranty of any kind, to the maximum extent permitted by applicable law. The Developer is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you; to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the Developer's sole responsibility.

7. Product Claims
The Developer, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

8. Intellectual Property Rights
The App, including its design, graphics, and sound-classification logic, is the property of the Developer. In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, the Developer, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

9. Legal Compliance
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties. You agree to use the App in compliance with all applicable laws, including local laws regarding audio monitoring in your jurisdiction.

10. Third-Party Terms and Beneficiary
You must comply with any applicable third-party terms of agreement when using the App. You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

11. Termination
These Terms are effective until terminated by you or the Developer. Your rights under these Terms will terminate automatically if you fail to comply with any of their provisions. Upon termination, you must cease all use of the App and delete it from your devices.

12. Limitation of Liability
To the maximum extent permitted by applicable law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data or profits, arising out of or related to your use of or inability to use the App. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

13. Changes to These Terms
The Developer may update these Terms from time to time. The current version will always be available at this page, with its effective date shown above. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law
These Terms are governed by the laws of Hungary, without regard to conflict of law principles, except where the mandatory consumer-protection law of your country of residence provides otherwise.
